State Representative Adam Mathews (R-Lebanon) has introduced a concurrent resolution to begin removal proceedings against Judge Ted Berry. This follows Judge Berry’s public comments on social media last month, in which he celebrated the political assassination of Charlie Kirk.
Mathews stated, “Judge Berry has had more than a month to take the honorable path and resign. The people of Ohio deserve a judiciary they can trust to be fair, unbiased, and beyond reproach. Judge Berry’s actions have fallen far short of that sacred trust, and now the legislature must act to defend the courts.”
The statements by Judge Berry are said to violate several rules of the Ohio Code of Judicial Conduct. These include the requirement for judges to uphold public confidence and avoid impropriety, prohibitions against bias or prejudice based on race, the mandate that judges must not let political or personal interests affect their duties, and guidelines regarding disqualification due to public statements reflecting bias.
The House resolution was filed by Mathews along with Representative D.J. Swearingen (R-Huron), who is the Vice Chair of the House Judiciary Committee. This action follows Mathews’ earlier call for Judge Berry’s resignation made on September 12, 2025.
